Nursing home corporations that violate the law and understaff their facilities, pose a risk of serious consequences and harm for their residents. Bed sores, infections, fractured bones, significant weight loss, dehydration and unexplained deaths are all potential signs of nursing home abuse and neglect. Nursing home residents have a right to receive better care and treatment than what is often provided.
As a nursing home abuse lawyer who handles cases in Port Charlotte, Punta Gorda, Englewood, North Port and throughout much of Florida, I examine complaint and annual surveys of area nursing homes. If you are in the process of selecting a nursing home in Charlotte County, Sarasota County or Manatee County, Florida, you should be aware that the State of Florida Agency for Healthcare Administration regulates nursing homes and conducts annual surveys and complaint investigations. Those nursing homes with a pattern of problems are often placed on the state’s “Nursing Home Watch List.”
On September 21 through September 24, 2015, the State of Florida Agency for Healthcare Administration conducted an unannounced investigation at Life Care Center of Punta Gorda, which is located at 450 Shreve Street, Punta Gorda, Florida 33950. At that time, state investigators cited Life Care Center of Punta Gorda for failing to meet the guidelines set forth under the Nursing Home Reform Act of 1987 signed into law by President Ronald Reagan as well as state regulations. Those citations of deficiencies against Life Care Center of Punta Gorda included:
F279 Failing to results of the assessment to develop, review and revise the resident’s comprehensive plan of care.
F329 Failing to ensure that each resident’s drug regimen is free from unnecessary drugs.
F353 Failing to have sufficient nursing staff to provide nursing and related services to attain or maintain the highest practicable physical, mental and psychosocial well-being of each resident, as determined by resident assessments and individual plans of care.
F431 Failing to appropriately maintain, label and secure medication.
N094 Failing to label drugs and biologicals in accordance with currently accepted professional principles.
Nursing homes like Life Care Center of Punta Gorda are required to comply with the above provisions that are contained within the Nursing Home Reform Act of 1987 in exchange for receiving taxpayer money through Medicare and Medicaid.
